The City of Houston offers its anti-human trafficking resources for free. To track the impact of our work, we would appreciate receiving acknowledgment when you use our toolkits. Please indicate how you plan to acknowledge the City of Houston. Examples can include acknowledging the City of Houston in official press communications, linking to our toolkits on your website, etc. Please note: You will have access to all of our toolkits, regardless of your ability to officially acknowledge the City of Houston.

Guidelines for Responsible Use

Use the Massage Establishment Ordinance Toolkit in a responsible fashion by following the below guidelines:

  1. We respectfully ask that you do not represent yourself as a City of Houston employee or member of the Houston Area Council on Human Trafficking when using the Toolkit’s information and resources.
  2. The documents contained in the Massage Establishment Ordinance Toolkit are not meant to serve as legal advice and should not be relied upon as such.
  3. The City of Houston has a strong mayor system, rather than one based on city managers. Consider how to adapt the resources in the Toolkit based on how your municipal government operates.
  4. Consider how to best coordinate your efforts to revise your city’s massage establishment ordinance. The Mayor of Houston has a dedicated Special Advisor on Human Trafficking, who helped to successfully coordinate ordinance changes. Identify a lead individual or agency to spearhead your efforts.
  5. Be aware of the stakeholders to whom you need to present the Toolkit’s resources. Successfully passing revisions to massage establishment ordinances requires the collaboration of council members, as well as external parties, such as professional and accredited massage associations.
  6. Many of the resources in the Toolkit are Houston-specific, such as the scope of the illicit massage establishment problem in Houston. When using these resources, make sure to adapt them to your city’s specific problem.

WHEREAS, the (Participant) wishes to access information contained in the City of Houston’s (Houston) humantraffickinghouston.org website (Program); and

WHEREAS, Houston is willing to allow such access to the Program website information at the sole risk of the Participant, and

WHEREAS, the Participant individual ACKNOWLEDGES and UNDERSTANDS that he/she will be accessing information in the Program at their own risk. The Participant will abide by all applicable federal, state and local laws, as well as the rules and directions of the Program’s coordinators.

NOW THEREFORE, IN CONSIDERATION OF MY BEING PERMITTED TO PARTICIPATE IN THE PROGRAM, AT MY SPECIAL INSTANCE AND REQUEST, I FOR AND ON BEHALF OF MYSELF, MY HEIRS, EXECUTORS, ADMINISTRATORS AND ASSIGNS, RELEASE, ACQUIT AND FOREVER DISCHARGE THE CITY OF HOUSTON, TEXAS, TOGETHER WITH ITS FORMER AND PRESENT ELECTED AND APPOINTED OFFICIALS, LEGAL REPRESENTATIVES, AGENTS, SERVANTS, EMPLOYEES, VOLUNTEERS (IN BOTH THEIR PUBLIC AND PRIVATE CAPACITIES), SUCCESSORS AND ASSIGNS AND ALL AFFILIATED PERSONS AND ENTITIES, INCLUDING HUMANTRAFFICKINGHOUSTON.ORG (PROGRAM) (HEREINAFTER COLLECTIVELY HOUSTON), OF, FROM AND AGAINST ANY AND ALL LIABILITIES OF EVERY KIND, CLAIMS, CAUSES OF ACTION, WHETHER AT LAW OR IN EQUITY, IN CONTRACT OR TORT, UNDER STATUTORY OR LOSSES, JUDGMENTS, FINES, DEMANDS, DAMAGES, LOSS OF USE OR SERVICES, OR INJURIES TO REAL AND/OR PERSONAL PROPERTY AND/OR PERSONS (INCLUDING DEATH) (COLLECTIVELY CLAIMS), AND DO FURTHER AGREE TO DEFEND, INDEMNIFY AND HOLD HARMLESS HOUSTON OF FROM AND AGAINST ANY AND ALL CLAIMS (INCLUDING ALL EXPENSES OF LITIGATION, COSTS, AND ATTORNEYS’ FEES) ASSERTED BY ANY PERSON OR ENTITY AGAINST HOUSTON WHETHER ARISING OUT OF, TOUCHING UPON OR IN ANY WAY RELATING TO THE PROGRAM AND/OR THE PRESENCE, MALFUNCTION, MAINTENANCE, ADDITION, SUBSTITUTION, USE OR CONDITION OF ANY TANGIBLE PERSONAL, OR REAL PROPERTY OWNED, LEASED, OPERATED, OR UTILIZED BY HOUSTON IN CONNECTION WITH THE PROGRAM IF THE CLAIM IS THE RESULT OF THE ACTUAL OR ALLEGED SOLE NEGLIGENCE OF HOUSTON AND/OR THE RESULT OF THE ACTUAL OR ALLEGED JOINT OR CONCURRENT NEGLIGENCE OF HOUSTON AND ANY OTHER PERSON OR ENTITY AND/OR THE ACTUAL OR ALLEGED STRICT, STATUTORY OR CONSTITUTIONAL LIABILITY OF HOUSTON.
